Introduction

These Terms of Service govern your access to and use of Kicklet.app and its related services. By using Kicklet, you agree to these Terms. If you do not agree, do not use the service.

1. Services Provided

Kicklet provides tools for Kick creators and viewers, including chatbot automation, commands, moderation, widgets, analytics, content utilities, downloads, and related features. Some features require a Kicklet account, a connected Kick account, or a paid subscription. Features and limits may change over time.

2. Kick OAuth, Accounts, and Access

• Kicklet uses Kick OAuth to sign you in and connect supported Kick functionality. Kicklet does not receive or store your Kick password.

• You are responsible for the security of your Kick account, devices, active browser sessions, and any additional Kick accounts or channels you connect to Kicklet.

• You may only connect or manage accounts, channels, and identities that you own or are authorized to manage.

• If you suspect unauthorized access, secure your Kick account, revoke affected access through Kick where appropriate, and contact Kicklet support.

3. User Content, Automations, and Acceptable Use

• You retain ownership of content and configurations you create. You grant Kicklet the limited permission needed to host, process, transmit, and display them to provide the service.

• You are responsible for commands, scripts, bot messages, moderation rules, downloads, AI-assisted output, and other actions configured through your account. Review and test automations before enabling them.

• You must have the necessary rights to content you upload, process, download, or distribute through Kicklet.

• Do not use Kicklet for unlawful activity, spam, harassment, impersonation, unauthorized access, interference with the service, or violations of Kick rules or third-party rights.

4. Third-Party Services

• Kicklet depends on third-party services, including Kick for authentication and platform functionality and Stripe for payment processing. Your use of those services may also be subject to their own terms and policies.

• Kicklet does not control third-party platforms. API changes, outages, restrictions, account actions, or revoked permissions may limit or disable related Kicklet features.

5. Service Availability and Changes

• Kicklet is provided on an as-available basis. We do not guarantee uninterrupted, error-free, or permanent availability of any feature.

• We may maintain, modify, replace, limit, or discontinue features. Where reasonably practicable, we will provide notice before material changes that significantly reduce a paid service.

• You are responsible for keeping copies of information that you cannot afford to lose.

6. Subscriptions, Renewals, Cancellation, and Refunds

• Paid subscriptions are billed through Stripe on a recurring monthly or annual basis, according to the plan, price, currency, and billing period shown at checkout.

• By subscribing, you authorize recurring charges to your selected payment method until the subscription is canceled or otherwise ends.

• You can manage or cancel your subscription through the available billing controls. The cancellation timing and the date paid access ends are shown during the cancellation process and may be immediate or at the end of the current billing period.

• Payments are generally non-refundable except where required by applicable law or where a refund is expressly offered. Any approved refund may be processed through Stripe.

• If a payment fails, is reversed, or becomes disputed, paid access may be suspended or ended.

7. End of Paid Access and Free-Tier Limits

When a paid subscription or other Premium access ends, Premium-only functionality may stop working. Content or configurations above Free-tier limits may be disabled, paused, or made read-only rather than immediately deleted. Resubscribing does not guarantee recovery of data that has already been deleted under the applicable retention rules.

8. Pricing Changes

We may change subscription prices or plan contents. Price changes for an existing subscription will apply no earlier than a future renewal after reasonable notice, unless the change is required by law, tax rules, or a third-party payment requirement. You may cancel before the new price takes effect.

9. Suspension and Termination

• We may restrict, suspend, or terminate access when we reasonably believe these Terms have been violated, an account creates security or legal risk, payment is not completed, or action is needed to protect users, third parties, or the service.

• Where appropriate, we may provide notice or an opportunity to correct the issue. Immediate action may be taken for serious abuse, fraud, security threats, legal requirements, or urgent harm.

• You may stop using Kicklet at any time. Ending use of the service does not automatically cancel an active paid subscription; use the billing controls to cancel it.

10. Disclaimers and Limitation of Liability

• To the maximum extent permitted by applicable law, Kicklet is provided without warranties of uninterrupted operation, fitness for a particular purpose, or compatibility with every third-party change.

• To the maximum extent permitted by applicable law, Kicklet will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from use of or inability to use the service.

• Nothing in these Terms excludes or limits liability or rights that cannot legally be excluded or limited.

11. Applicable Law and Mandatory Rights

You must comply with the laws that apply to your use of Kicklet. These Terms do not limit mandatory consumer or privacy rights that apply to you based on your location. Any dispute, governing-law, or venue requirement that cannot legally be changed by contract remains governed by applicable law.

12. Changes to These Terms

We may update these Terms when the service, our practices, or legal requirements change. Material changes will be posted on the website or communicated through the service and, where appropriate, by email. Continued use after the effective date of revised Terms means you accept them.
